Common Theft Crime Charges

The terms “theft,” “burglary,” and “robbery” are often used interchangeably in casual conversation, but each carries a distinct legal definition under Texas law. 

  • Theft refers to unlawfully appropriating property with the intent to deprive the owner of it. This includes situations such as shoplifting or embezzlement and often involves non-violent means.
  • Burglary, on the other hand, involves unlawful entry into a structure with the intent to commit a crime, such as theft or assault. Burglary doesn’t necessarily require property to be stolen. The illegal entry alone is often sufficient to establish a charge.
  • Robbery involves the use or threat of force during the act of theft. This added element of violence means robbery is treated as a more severe offense and carries stiffer penalties than theft alone.

Some of the theft charges that most frequently arise include: 

  • Petty theft. If stolen items are worth at least $100 but less than $2,500, the crime is typically charged as a misdemeanor.
  • Grand theft. If the property’s value exceeds $2,500, Texas law escalates the case to felony theft.
  • Auto theft. Taking or attempting to take a motor vehicle without the owner’s consent.
  • Identity theft. Stealing someone’s personal information, such as Social Security numbers or financial details, to commit fraud.
  • Theft by check. Writing bad checks with insufficient funds to cover the payment.
  • Employee theft. Misappropriating funds or property from an employer.
