Misdemeanor Crimes in Texas

Texas law classifies misdemeanors into three levels--Class A, Class B, and Class C: 

Class A Misdemeanors

Class A misdemeanors are the most serious type of misdemeanor in Texas. These offenses carry penalties of up to one year in county jail and fines of up to $4,000. Examples of Class A misdemeanors include driving with a blood-alcohol content level of 0.15% (nearly twice the legal limit), assault causing bodily injury, and possession of small amounts of certain controlled substances. 

Class B Misdemeanors

Class B misdemeanors can result in up to 180 days in county jail and fines of up to $2,000. Crimes classified as Class B misdemeanors include a first offense for DWI, the theft of property valued between $100 and $750, or possession of up to two ounces of marijuana. 

Class C Misdemeanors

Class C misdemeanors are punishable by fines of up to $500. These offenses do not carry jail time. Common examples of Class C misdemeanors include minor traffic violations, public intoxication, and theft of property valued at less than $100.

Defenses could hinge on procedural errors during the investigation or arrest, such as failure to read a suspect’s rights or illegal searches and seizures. What’s more, many cases allow for negotiation of plea deals or alternative resolutions, like deferred adjudication, which can keep the charge off your record.
